William Hill loses against 32Red
Back in October 2010, 32Red, a UK online casino, entered a case against William Hill for utilizing the name of 32Vegas. 32Red protested to William Hill making use of the 32Vegas brand as those signs were too similar to 32Red‘s which caused confusion amongst consumers.
Last year, the High Court ruled in favor of 32Red but William Hill appealed this decision.
But yesterday, Tuesday, the Court of Appeal rejected William Hill’s plea saying the giant UK gambling company had infringed the 32Red trademark.
It was also noted that William Hill’s defense team went into a fully fledged disagreement on the last judgment made on the matter and refuted each and every aspect of it.
32Red has been applauded for successfully winning its trademark infringement action against William Hill. Even if 32Red is not all powerful as William Hill, 32Red has still been able to make its voice heard and this has paid.
Talking of paying, William Hill has been ordered to compensate 32Red £70,000 within 2 weeks; those count for the costs related with the appeal. However, this is not the end of it as full damages have yet to be settled and could amount to a consequent sum.
32Red’s chief executive, Ed Ware was pleased with the Court’s judgment saying that it has protected their intellectual property rights and this should discourage anyone to even think of breaching their brand again.
As for William Hill, they are not happy with the sentence but they had already stopped using the 32Vegas brand, which was later re-named 21Nova when 32Red starting their legal proceedings. But now, William Hill intends to put all this behind them and give all attention to their business.
